Section 1 — Scope
These terms and conditions apply to all contracts concluded by consumers through the Kilea Print online shop with
Selina BachmayrIn den Seien 14
67685 Schwedelbach
as the contracting party.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.
Section 2 — Formation of the contract
The presentation of products in the online shop does not constitute a legally binding offer.
The customer first selects an occasion, design and product, together with colour, size and quantity where applicable, and adds the goods to the basket.
Before completing the order, the customer can check and correct their entries.
By pressing the final order button, the customer submits a binding offer to conclude a purchase contract.
The contract is formed once Kilea Print expressly confirms the order or begins to fulfil it.
An automated acknowledgement of receipt of the order alone does not constitute acceptance unless it is expressly described as an order acceptance confirmation.
Section 3 — Prices
All prices shown are total prices.
Kilea Print applies the small-business exemption under section 19 of the German Value Added Tax Act (UStG). VAT is therefore not shown separately.
An additional shipping charge of €4.90 may apply.
Shipping is free for orders of €100.00 or more.
Section 4 — Payment
Payment is made through Stripe Checkout.
The payment methods available at the time are shown to the customer during checkout.
Section 5 — Delivery
Delivery is available only within Germany.
Delivery generally takes 3–4 working days from receipt of payment unless a different delivery time is stated for the product concerned.
Section 6 — Retention of title
The goods remain the property of Kilea Print until payment has been made in full.
Section 7 — Right of withdrawal
Consumers have the statutory right of withdrawal as set out in the separate withdrawal policy.
Section 8 — Personalised goods
There is no right of withdrawal for goods made to the customer’s specifications or clearly tailored to personal needs, provided the statutory conditions are met.
A standard selection from the designs, colours and standard sizes offered by Kilea Print does not, by itself, constitute an individual customer specification within the meaning of this provision.
Section 9 — Legal guarantee
The statutory rights relating to defects apply.
Section 10 — Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.
